Thought it would never happen to me.

Earlier tonight I was smoking weed out of my gravity bong. The dorms are practically empty right now, as everyone left for home tonight. Even if people were here, I wouldn't have thought much about it, as I smoke 2 times a day in my room and haven't had a problem yet. I burn a ton of incense, and always have a fan sucking air out my window. After I finished smoking, I put the GB bowl, my weed, and my lighter under my hat, which I put on the table next to me. Than I relaxed, listened to some phish, and watched some tv. About an hour after I finish smoking, there's a knock on the door. I get up and open it, and there are two cops standing outside!

The don't even ask permission to enter, and just barge in. My gravity bong is sitting out in the middle of the floor, but they ignored it. They noticed that I was really high, though. However, I pointed out that this isn't illegal, and said that I had smoked with someone else earlier. They asked to search, but I refused to give consent. There was absolutely no smell of weed in the room, either. After a few minutes of random questions, they decided to leave. They said that they weren't going to cite or arrest me, and hoped that the situation would never repeat itself. During our exchange, I learned that someone on my floor had called the cops because of the strong smell of INCENSE coming from my room. No weed smell was mentioned.

Ten minutes later, though, both cops returned with a third cop. I again refused to give consent. Instead of leaving, though, they said that one of them would remain in my room until they could get a warrent. The new cop than notices the gravity bong on the floor, and says that although it gives them probable cause, they still want to get a warrent. I tried telling them it was just modern art, but they wouldn't take it. Two hours later, warrent in hand, they tear my room up. They found about 1/8 of weed, 2 scales, a gravity bong and a pipe. They also took my rolling tobacco and accompanying rolling papers, along with my lighters (!). However, they left all my visine, incense, and cigarettes, along with most of my weed, which was hidden very well. After finding everything, they decide to arrest me.

I spend the next two hours sitting down at the police station while all three officers do a mountain of paperwork. However, I am allowed to make a phone call. After they're done, they inform me that weed is a gross misdemeanor, and that I get to spend the night in jail. Luckily, I'm only there for about 3 hours before a bail bondsman arrives to get me out.

So here I am. I now officially have a criminal record, or will after my court date in December. I'll probably lose my financial aid, as well as being kicked out of the residence halls. Because of this, as well as the obvious dissapproval my parents are bound to express (no, there's no way to hide this from them), I'll probably end up dropping out. Luckily, I was only charged with 1 count of paraphenalia and 1 of possession, so I probably will end up with a suspended sentence or a few months of probation, although I'm sure the fines are going to destroy my savings.

Ugh.. I'd say that sucks, but that's probably the last thing you want to hear right now. Wish I had some advice, but i've never gotten into a situation that serious that was cannabis related. Do your parents know yet? If not, what will there reaction be? Sorry, it's not really my business but I hate to see the kind of thing happen to such an innocent "criminal". Most I can do is wish you the best of luck. So... Good Luck! Also, are you going to fight this thing out in court or just pay the fine and such? You said they just barged right in, their first probable cause was only that of incense? Sounds a little fishy to me but Niteshift would be the one to ask in this situation. Good luck again!

Sorry to hear it man, that really sucks.

I can't believe some people. Calling the cops cause they smelled incense, how low. Maybe after everything is done you should put up a flyer in your hall telling all the **** that happned to you(without using your name or anything) just because someone else decided to get involved for no reason. But then again the person who did it may just get off on reading it so maybe not.

Awww dude, that sucks, ****ing stupid. Thats so stupid a kid would call the cops because of incense, I hope he gets his share of karma. I wish I had some soothing words I wisdom. Smoking in private and you still got busted, god that hardly makes sense. I might be able to give you some good reasons why droping out isn't all that bad but other then that i'm drawing a blank as what to say. man, really sorry to hear about this, it's just awful to know there are people out there that would bust you even though it doesn't affect anyone else at all... just stay cool, let all this bull**** pass over and analyze the situation as it comes to you. i hope you will still be able to blaze, but i know it will be tough for you after you were busted in such a safe environment...

Cops arent aloud to just barge into your room without permission, are they? I think you need to fight this in court as hard as you can.

You should have kept bumping the desk as they filled out paperwork, theyd screw up so many times that they wouldnt even want to bother filling it out over again.

I feel for you though, brother. Check out some local community colleges in the meantime or make some money.
