Ok... I got arrested today and here is the story...

Me and Bob just got back from smoking weed, and we had spares for the rest of the afternoon. So we were blazing, just got back and planned to play games on the computers in school until the end of the day. Bob gets a call on our way into the school, and it's Jimmy who wants to buy some weed... so we get back into the truck and drive to where Jimmy is. After him and his buddies get into the truck, the cop from the other school is across the street in his truck and gets out.

The cop comes up to the truck and starts being all funny and stuff, sarcasm etc. "Ohhhh I bet there are a lot of drugs in here," stuff like that. So we start saying you have no probable cause, etc and he knows he doesn't which is why he hasn't started searching the truck yet. So he tells Bob to get out of the truck and give him his liscence and registration, so he does. While hes out of the truck, the cop sees a bag on the seat and says "ohh whats this? there's your probable cause right there" and it was a bag from Bob's lunch (no joke). So we're like, thats bull****.. and so Jimmy calls his dad who knows all about the law etc, and I plan to call my dad who does as well. Then the cop from our school gets there, searches us, searches the truck, and the other cop leaves while this one searches us all.

While he searches us all, Bob says "where's did super cop #2 go?" and the cop says "watch your ****in mouth!" so yunno, we just stay quiet for the rest of the time cuz it's obvious hes just gunna be an asshole. In the truck he finds almost a quarter ounce of weed, dime-bags, 3 glass pipes, 1 wooden pipe, and money.

Eh, they did have probable cause, though they were overzealous here.

The law is the law. You know you're breaking it by smoking. Just try your best not to get caught...

Well, they shouldn't treat you like **** in the first place, but you were in posession, so they can legally arrest you, or take away your ****. However, if they caught you high, they can't so ****, unless you're driving high..lol.

Hm, I think you and your friends had it coming. Don't expect to be an ass to cops and get any sympathy from them. "You don't have probable cause" and stuff like threatening to call parents when you DO have weed is asking to get caught. Probable cause is a funny thing, they can make anything probable cause, because its the cops word against yours. Take this as a learning experience, that being a complete ass to ANY figure of authority able to arrest or detain you, will not get you anywhere. It is quite possible that you could have gotten out of it with some respect and playing his game.

No no, by the time we went and picked up our buddy to sell to, we were burning out. When the cop got out of his truck and came up to us, we had nothing out, and he saw us with nothing, he just knew this one kid in the truck as a bad kid and thought he was up to something.

And also, on the school suspension form I got, it says I'm suspended with possession of narcotics on school property, when I was in fact not in possession of narcotics (nor was i in possession of weed... well.. like, 0.3 of a g, and there were NO narcotics in the truck so I don't know why it says that) and nor was I on school property. My dad who is in law school is phoning them tommorow and fighting this.

Yeah, by the way... he also took all the money, and all the weed, and there was no official write-up of anything that happened. So what he's doing with the weed and money right now is a mystery.

While weed is not a narcotic, drugs in general are called narcotics. That’s why it says that. And .3 of a gram is considered possession.

Theres no way in hell a empty plastic bag can be considered probable cause. Maybe thats why there hasn't been a write up or charges laid.

So, were you ARRESSTED, or suspended? Your first post says you were arrested, but you never made any other reference to being arrested, just suspended, with the weed and stuff confiscated. If you were actually arrested, they'll need evidence, so if the cop "disposes" of it, there's no case. However, if you were merely suspended, the guidelines are much less strict. you have far fewer rights as a minor on school porperty than you do elsewhere, and they don't have to play by the same rules as cops elsewhere do. While it sounds unfortunate, this could have all been avoided by one piece of advice I've always urged people to follow....DON'T BRING WEED TO SCHOOL.....is a little buzz worth all the problems it causes? Smoke before school if you must, ditch school and get high, whatever....almost ANY choice would be better than bringing it to school, especially if you're careless enough to get caught.
