Hmmm.. I don't think they'd get him for trafficing or intent to distribute or anything. They usually only do that if it's a huuuuuuuuge amount of weed that couldn't possibly be for one person, or if there are dime bags, or scales, and such found too.

In my state 4 ounces isn't considered personal use. If anyone is caught with 4 oz's and up they are charged with intent to sell.

uhhh if hes driving just make sure you triple ziplock the bag and put it in a dufflebag full of clothes and other travel crap and put it in your trunk, then go drive cross the border. im canadian and iv never had a customs agent search my car going either way EVER, mind you iv never tried to bring weed across the border. but long as you dont do anything stupid and you just go up for the day to say visit a friend i dont think youl have a problem.

Yeah definetely don't risk it. I live in MI and you wouldn't believe the number of arrests on the border there are because of this stuff.

If he were to get caught coming back across the border, would his trial or whatever be in the state that he's coming into? For instance, if he went from ONT into NY, and got caught, and (for instance) New York's state law says that the amount he has is not intent to sell, but his state says that it is, then what would happen. Or is smuggling a law governed by the federal governemnt?

If the first thing I said was true, then do your research as to what state you want to be coming into.

It would have nothing to do with his state of residence. The prosecution would take place in whatever state he was arrested in. One state's laws cannot be enforced in another state. Thats why we have jurisidction....it would be complete and utter chaos if one state's laws were enforcable in another state. it would mean massive confusion in the court system, and officers being required to know the laws in all 50 states, which would basically be impossible to keep up on.

One of my cousins was charged with "importation of a controlled substance" when he was busted with 100 pounds on the border. His case was prosecuted in the federal court system, not state....

It may depend on how much weight your holding though, if it's not a significant ammount (less than an ounce or so) I'd imagine you'd probably just get busted for possesion.
