Claim provocation, do you have a previous criminal record? If not this will work in your favour, also think of an excuse as to why you would need a knife. Claim you didn't know it was still in there after going fishing or whatever.

Admit to what you did, there are enough witnesses already and if you've been interviewed you've probably as good as pleaded guilty already. Also if you plead guilty before court then you up to 1/3rd of your sentence will be taken off, however only 1/10th if you plead guilty once the trial has begun.

In your favour them being racist is a big plus in your favour, any person acting hostile against a certain race, religion, sexual orientation, disability etc will give the chance to claim provocation and that will be taken into account.

They'll also look at your age, which will work in your favour. Community sentences are being used a lot now, anyone under the age of 21 the courts main aims are Reformation and Rehabilitation, they don't want one slip up turning you against the judicial system.

How are you doing at school? Do you have a previous history of violence? Do your teachers like you? All of this will be asked in a presentence report from you're school.

If I were you i'd plead guilty, you won't get a full discharge as after all pulling a knife out in a school is extremely serious. I'd claim provocation, sign yourself into anger management before your trial to show that you're trying to solve the problem; if you're lucky you may get a deffered sentence. Make sure they know that they were being racist and think up an excuse for having a knife (other than self protection), if they think anything was premediated you're fucked.

You will almost certainly be expelled from school, letting you back in would be out of the question as if another incidence between you and these kids happened the school would be in shit too.

If this goes in your favour, you'll be fine.

disclaimer - basically my entire reply is redundant as that is of my knowledge of english law, but the basic principles are the same regarding aims of punishment.

ALSO! why does the freeking hand book say you can have knives (under 3 inches) AND YET! you cant have them at the same time cause its a "lethal weapon"
i have an airsoft gun in my car for past 3 months..THATS a lethal weapon (depends on rage and creativity)
so...my school is fucked up XD
i bet they call my pocket knife a lethal weapon, even though the blade is sooo daul i can rip it across my hand 1000 times and not get a scratch

I find it dumb that your schol allows knives at all. Granted, in my high school, knives were common, but thats becasue I went to a school full of rurual kids who grew up on ranches. When you live and grow up in that kind of environment, a knife is a tool, not a weapon, and sticking it in your pocket is simply part of the routine of getting dressed in the morning. Technically, you weren't allowed to have them, but unless you were drawing attention to yourself somehow, you wouldn't get in trouble for having one. In fact, I remember a few occasions where I actually offered my knife ( 4 in. lockblade Buck) to my teachers when they needed to cut something, witout even getting so much as a strange look.

I went to school in a ROUGH school...and yes I carried a weapon most times...BUT I NEVER USED IT, even when I WAS getting in a fight, or tha recipient of racial slurs. I had it for protection, and would only pull it out if I thought it was a life or death matter. You don't need a knife for a fight, that is just a cop out...get your a$$ kicked like a man, even if its a few to one...go home and heal your wounds, then use that rage as fuel to change your surroundings. Violence never accomplishes as much as maturity and drive.

OK, I have some experience here from the " other" side..

Read the whole post, dont freak out= chill for a moment......

Due to the No Child Left Behind act, every U.S. school system must adopt a 0 tolerance weapons policy. (federal funding) No U.S. school system allows a knife, nun chucka's, etc.
1) You are slam dunked expelled from your primary school. You will be able to attend alternative school & complete your H.S. diploma.
2) You will most likely be placed on a modified intensive probation program that WILL include piss practice (you must remain free/clear of ALL drugs-alcohol for the immediate future)
3) You will have a mandatory mental health/substance abuse evaluation usually at the county MH facility & treatment. (again, a done deal)
4) You will have community service in conjunction with every thing else.
5) Any breach of probation standards & you will be charged & at 17, can be as an adult.
6) You most likely loose your driver's license until 21. (Columbine effects)

Now the good news= If you have no Juv. record
, this can be expunged at 21 & will become a sidebar story in 5 years. (very good deal!)
If you form a RESPECTFUL relationship with your probation officer, they can recommend modifying conditions in the future...

Just learn from this & grow, @ 17, you will be given every opportunity to make ammends & suffer little w/ a good attitude. Just remember: you need not defend honor with deadly force. Turn this as positive as you can.

Further, provocation is not an acceptable defense as bringing a weapon to school is the act which brings the mandatory consequences.
In Ga. the charge would be aggravated assault/felony (regardless whether injury occured or not) DO NOT take this lightly, don't take any more chances.
