I got arrested a couple months ago for being intoxicated in public and I had about a gram or under of weed on me. I spent the night in county jail and I have a superior court hearing in a couple days. If any of you have gone through this I would like to know what your experience was like in court and if I have the chance to present the case in my own words to the judge. If I tell the judge the whole story I hope that he'll see that it was just a huge misunderstanding in terms of my arrest. I think he'll sympathize with my situation and give me the minimal punishment if any. Is this at all possibe?? I don't want to get in to my exact situation about the arrest because it was very embarassing but I plan to tell the whole truth to the judge and I'm hoping he'll sympathize with me. By the way I'm in California so those laws apply.

California is a great state to try your case in. They have relativley lax laws when it comes to cannibis already, and if you have a story that explains the situation well im pretty sure one could come out infront of the court system.

yeah just say you were trying to get home, and you thought you'd be reponsible and not drive, so you were walking through public. you were taking some weed that your friend gave to you as a present, and you were just trying to innocently go home. say your really sorry and that you had to get home to take care of something. say you didnt want to do it. etc etc. i dont know i came up with this while being fucking high as hell which i am now. so tell me what you think

I live in california, and i got charged for posession of weed and posession of paraphanailia and being under the influence, all at school, and all i had to do was 30 hours of community service. Doesnt sound like your charges are too major, you should get off pretty easy, especially if you have a good explanation.

I've never heard of anyone here getting arrested for public marijuana intoxication. I've only heard that happen with alcohol here...I've heard of being obviously fucked up as reasons for a search though.

anyone firstly let me start of by having a chuckle at the fact you have to go to a superior court over possession of marijuana what happens if you commit a real crime out there? get called to the Super XXL Grand Superior Courts?

anyway it's a pretty much straight forward procedure with set punishments, you'll have your chance to speak & ask for your circumstances to be taken into account. basically just remember to look smart, talk clearly & don't do dumb shit like lean against judges table or shit.

Not exactly 'public intoxication" but I HAVE been charged with "use of an intoxicant other than alcohol" which is basically the same thing.

Thats messed up man. Its illegal to drive under the influence and when you are actually responsible enough to walk home they catch you for public intoxication. I'm with NWA on this one, f**k tha Police. Are you 21 or is it even for alcohol.

HAS anyone heard what they are doing in Texas? Police are actively
patrolling INSIDE of bars, and arresting people for public intoxication if they reach a certain BAC (Blood Alcohol Content). How messed up is that?

For some reason I thought alcohol was legal once you turn 21. I guess not. Although I still dont agree with it if you look at from their point of view they are trying to stop those hardcore drinkers who drink till they pass out and do very dumbass things in the process. For example, meaningless fights, DUIs, and this one is for one of my dumbass friend, carrying a stereo on his shoulder walking in the street without shoes or socks on yelling stupid shit at every car that passes him by.
