Default State Sovereignty!

This is the biggest thing to happen in American politics since the civil war.

22 States have introduced bills within their own state legislatures to affirm their sovereignty under the 10th amendment of the constitution. The bills state that the federal government has been trampling on the constitution for years, and that if the federal government will not follow the constitution, this nullifies any obligation the state has to the federal government.

In essence the bills say "Follow the constitution or else we won't support the federal government"

I have provided a copy of the Michigan state legislature below

Rep. Opsommer offered the following concurrent resolution:
House Concurrent Resolution No. 4.
A concurrent resolution to affirm Michigan's sovereignty under the Tenth Amendment to the
Constitution of the United States and to urge the federal government to halt its practice of imposing
mandates upon the states for purposes not enumerated by the Constitution of the United States.
Whereas, The Tenth Amendment to the Constitution of the United States reads as follows:
"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States,
are reserved to the States respectively, or to the people"; and
Whereas, The Tenth Amendment defines the total scope of federal power as being that
specifically granted by the Constitution of the United States and no more; and
Whereas, The scope of power defined by the Tenth Amendment means that the federal
government was created by the states specifically to be an agent of the states; and
Whereas, Today, in 2009, the states are demonstrably treated as agents of the federal
government; and
Whereas, Many federal mandates are directly in violation of the Tenth Amendment to the
Constitution of the United States; and
Whereas, The United States Supreme Court has ruled in New York v. United States, 112 S.
Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes
of the states; and
Whereas, A number of proposals from previous administrations and some now pending from
the present administration and from Congress may further violate the Constitution of the United
States; now, therefore, be it
Resolved by the House of Representatives (the Senate concurring), That we hereby affirm
Michigan's sovereignty under the Tenth Amendment to the Constitution of the United States over all
powers not otherwise enumerated and granted to the federal government by the Constitution of the
United States. We also urge the federal government to halt its practice of imposing mandates upon
the states for purposes not enumerated by the Constitution of the United States; and be it further
Resolved, That copies of this resolution be transmitted to the Office of the President of the
United States, the President of the United States Senate, the Speaker of the United States House of
Representatives, and the members of the Michigan congressional delegation.

Personally I think the federal government needs to go. I mean, I like Obama and all but quite frankly I think the federal government is an abomination, our states can rule us just fine.

Nice article, it will be interesting to see what this leads to. I tend to agree with your last statement there. The federal government has definitely over stepped their boundaries when it comes to controlling the states. A huge reason we are where we are is because of the federal government acting irresponsibly.

i don tknow how the next couple yers are gonna turn out for america and the world. it seems like the "all powerfull nation" is starting buckle under its own weight and theres no one left in the world to really support us. weve sorounded ourselves with enemies playing world pollice and being the responsible one. and now states are going against the feds and stuff and i think its all just gonna end in the next 50 years. its kinda of a scary thought to think of. with everyones guess that chine wil be the next super power whats gonna happen? im not pro goverment and what-not. im just worried, doe any one else feel this way?

I agree to a point with this. The Federal government is an abomination that would make our four fathers turn in their graves. But no federal government I think is extreme. I think the Federal government needs to be reminded of what its there for. To protect us from enemies, and to promote our general welfare.

The fed gov needs to be reminded that it has no affairs in state rights.

I absolutely agree. There are a lot of things today that would just sicken our founding fathers, and a good majority of those stem from the Federal government. It's about time the States started to stand up to the government, I mean after all its the Feds fault we are where we are today.

Hell yeah! Give the power back to the States! When the federal government uses the Constitution (perhaps the greatest man-made document in existence) as nothing more than toilet paper, the States have to take a stand.

We Never thought We would have a President, of The United States, of color, in our lifetime. The States are starteing to come around too. We are on a roll. the trouble is, we are in some kind of War, killing off,and, brain washing another generation. When they get Home, the numbers will change. Basically the U.S. has been heading this direction since Andrew Jackson's Presidency, he was really the first President that started using the Federal Government for more than what it was intended for. The kicker is that before he was President Jackson was a huge proponent of State's rights over Federal.

It's hard for me not to go on a rant about this, it's a subject I believe very dearly in. Not only has the Fed. Gov. been stomping on State's rights it's also been stomping all over individual rights as well.

I'll just end with this one example; the majority of the founding fathers were against a standing Army. They believed that if there's not a war going on then there should only be a small contingent of soldiers available for emergencies and that if need be they can build an Army and use the Militia. The Militia was the primary force used in those times, there was no such thing as a National Guard, basically every able bodied man could be called upon to take up arms.

The majority of the founding fathers were slave owners as well.
It was the federal government that integrated the schools in the South. It was the federal government that enacts the polution control laws for this country. Its the federal government that maintains the national park systems. The list goes on and on. If it was left to the states, some parts of this country would be third world and others would be dictitorial.
