Default US election satire makes Dutch 8 o'clock news

Ok, you've probably all seen it already but this animation from JibJab is so brilliant the Dutch 8 o'clock NOS news showed the entire animation yesterday and rightly so. Kinda sums up the campaigns quite nicely imo.

Since there is an international and political aspect and it isn't limited to one candidate I figured I'd post it here.

JibJab, the creators of this parody are being threatened with a copyright lawsuit by of Ludlow Music, Inc, which owns the copyright to "This land is your land". This is absurd; clearly this cartoon is protected as a political parody.

NEW YORK (CNN/Money) - With something as fun as a cartoon Bush and Kerry hurling musical epithets at one another, you knew lawyers would have to get involved.

And, unfortunately for JibJab.com, they have.

You know the Jibjab thing I'm talking about, right? The flash animation movie swirling around the Internet with President George Bush and Senator John Kerry singing to the tune of Woody Guthrie's "This Land Is Your Land."

Bush: "You're a liberal sissy!"

Kerry: "You're a right wing nut job!"

Both: "This land will surely vote for me!"

The bit is hilarious. Unless you are The Richmond Organization, a music publisher that owns the copyright to Guthrie's tune through its Ludlow Music unit.

"This puts a completely different spin on the song," said Kathryn Ostien, director of copyright licensing for the publisher. "The damage to the song is huge."

TRO believes that the Jibjab creation threatens to corrupt Guthrie's classic -- an icon of Americana -- by tying it to a political joke; upon hearing the music people would think about the yucks, not Guthrie's unifying message. The publisher wants Jibjab to stop distribution of the flash movie.

Of course the creators behind Jibjab don't agree.

"We consider it a case of political satire and parody and therefore entitled to the fair use exemption of the copyright act," said Jibjab attorney Ken Hertz.

So far there isn't a lot of money involved. The brothers who made the movie, Gregg and Evan Spiridellis, have been distributing it pretty much for free (a paid-download option was available, but abandoned as most folks went for the free-on-the-Internet route). But the two are getting a lot of media attention as more news organizations and talk shows feature the flash bit (I think CNN was first, by the way, when we featured it on "In The Money" in early July).

"We're just trying to catch our breath," said Gregg Spiridellis, before sending me on to his lawyer.

Right now lawyers for both sides are just hurling threatening letters at one another. If the dispute ends up in court, it'll be interesting.

TRO: "You've hurt our music!"

Jibjab: "You've got no humor!"

Both: "This judge will surely side with me!"

Funny --

I think Ludlow music has a VERY valid point.

The ability to secure intellectual property from being bastardized, stolen, misused, altered, pornagraphed, and perjured is a tangible right to an intelligible property, such as Music.

Copyright, the time during which control over that intangible, lasts for approximately 150+ years (a specific statutorily provided time, which changes periodically with changes in the law + "a life in being" to whome the copyright is attached). After that time it is Public Domain.

Ludlow music has the obligation to enforce that music for which it holds repsonsibility, is not used without permission and that it is not misued, or used in a manner not accordingly to the wishes and belief of the copyright owner and his family.

That is called protection of property rights.

What JibJab did was called stealing.

While it might be cute and funny, from a legal standpoint, it's a criminal act and breaking Federal Law that is accepted under International Law under International Copyright Treaties.

Not to say the piece isn't funny or doesn't make a point --- Just think restitution should be forthcoming and there is a valid case.

I disagree completely. Every parody "steals" a copyrighted work and distorts its original meaning -- usually to make someone laugh.

All the bands/musicians/artists that Weird Al Yankovic has parodied have just as much right to sue as Ludlow Music. And just as much right to lose.

Coolio (ok, even I can't believe I'm defending him, but still) had an intended message with Gangsta's Paradise. It was a quite serious message, from the perspective of the original song -- you don't hear anyone laughing. Amish Paradise completely distorts that, just as this new parody completely distorts the original serious meaning of This Land is Your Land.

An icon of Americana or not, This Land is Your Land or any other copyrighted work has GOT to be allowed to be parodied; it's as important a first amendment right as the one possessed by the artist that wrote the original.

And....Coolio did not give Weird Al permission when he was asked. He said "no".
Weird Al did it anyway. If it didn't fall under "parody" and the fair use exemption, I imagine as ticked as Coolio was, he would have gotten it stopped.

I think fighting over this is just more money for the lawyers and will actually keep it in the public eye longer than if you just let it die a natural death.
