"It's going to be close but we're confident we can get them," Larry Sandell, campaign manager for the committee, said.

The organization circulated an earlier petition to amend the Nevada Constitution to allow adults to possess up to an ounce of Marijuana, but didn't meet a deadline for getting the required signatures. It's appealing that case to the 9th U.S. Circuit Court of Appeals.

If the committee gets the signatures on the new petition, it will be presented to the 2005 Legislature which must act on it within 40 days. If the Legislature doesn't act or if it changes the petition, the issue will go on the 2006 election ballot.

The new Nevada initiative says, "Rather than spending millions of taxpayer dollars arresting Marijuana users, the state of Nevada should instead generate millions of dollars by taxing and regulating Marijuana, and earmark part of these revenues to prevent and treat the abuse of Marijuana, tobacco, alcohol and other drugs."

The state would license wholesalers and retailers to sell the drug. Each would pay $1,000 for an initial license and $1,000 annually for the permit.

A retailer or wholesaler couldn't locate within 500 feet of a school or church. Licenses for selling the drug wouldn't be issued to gas stations, convenience stores, grocery stores, nightclubs, gaming casinos or dance halls. Those businesses that sold liquor would be barred from selling Marijuana.

The proposed initiative would prohibit a person from driving under the influence of Marijuana. It would also prohibit possessing Marijuana in a public place, jail or public school.
Let's get some people's thoughts on this thing. Here are mine:

1) How are you going to pass a law allowing stores to sell an illegal substance? Wouldn't Marijuana possession have to be legalized before people could even consider opening stores? Does Nevada have medical mj?

2) What's with the "no possessing Marijuana in public" clause? How are you supposed to carry your purchase home from the store if you can't possess it in public?

Wow! I'll be speechless if they actually get a Pot Cafe open in the country who's government hates it most! But if they'll raid a little old latie growing medical marijuana, they'll most certainly raid a cafe. Even in Vancouver the cafe was raided, in probly the most leniant city in Canada.

Hiz Highness, as I was reading, I questioned the same 2 questions you asked. What is considered "public?" I guess your home wouldn't be public, but the law has to define public first. If they legalize cafes, they'll probly have po-lice outside and search every person who comes out. My opinion on this, sounds like a nice idea but I doubt it happens anytime soon.

Pretty crazy to think about, but I would consider that a dream more than a goal.

Ha, think about how different the vibes would be in Vegas' casinos if everyone were high....hmmmm.

I am wondering about public place? Could the sales be in a privately owned place then only consummed there as well? This would be similar in theory to the coffee shops of Amsterdam rules. The marijuana sold in shops is theoretically smoked in shops in A'Dam. It is a technicality but a police officer there could tell you to put out your joint if you were to smoke it on the streets or in a park in Amsterdam. Never happens. I was watching some parade go by last year in August and stood next to 2 polites (police) while burning some Whitw Widow and neither of the uniformed guys even payed any attention to me. What a great place to be!

Yes, I have allot more questions about this. Anyone knowing more is encouraged to educate us. I intend to grow for the state if possible. A coffee house sounds wonderful. That part someone else can run. I already have as they put it "a permanent number with the Dept. of Agrc.", so I think I'm on my way to being a grower if this happens. Anyway, I'm just starting out and can use more info and advice. Thanks

What ever you do, I think you have 3 or 4 years until you will be in business. The only real important aspect is to be on the inside of the information loop so your not knocked out of the starting line. When it happens, there will be a mad rush of people to fill those select few opprutunities. I would love to be the coffee shop owner, only thing is I am sure Nevada residency is a big requirement.

Even if this were passed, pot would still be illegal at a federal level. Asscroft and Walters would be frothing at the mouth and creaming their pants in anticipation of raiding such cafes.
