If a patron walks outside of the bar and is on the street then I could see giving someone a ticket, but not inside the bar. "Is druck driving a serious offence?"

Yes. Drunk driving is a very serious offense.


"Should the police be doing everything possible to stop it?"

Nope. There is a line. I don't think that busting people for getting drunk (in a bar for crying out loud!) is an acceptable way of busting drunk drivers. Why not arrest them as soon as they order their first drink? After all, if the point is to bust people for the law against public intoxication so that we can prevent them from breaking the law against drunk driving then it only makes sense to make a law against drinking in the first place so that we can prevent them from breaking the law against public intoxication.

Better yet, let's identify those that may be more susceptible to having a drink in the first place. Let's look into their family history, religious beliefs and whether or not they have ever considered getting drunk and put them in jail and just cut the whole thing off at the pass.

I doubt that even the people that wrote the law to begin with envisioned this. I mean, I always thought of the public intoxication laws as something to charge the idiot with that shows up at his kids soccer game drunk, or that kind of thing. Now I find out that the law can be enforced and interpreted much more broadly than I thought and that scares me.

There is a select group of people that would love to see all bars closed and this is yet another attempt at it. Okay, when they made laws against smoking in bars it ticked me off....but laws against drinking in bars?!!

If you can't make it illegal, you tax the heck out of it, restrict it to the point of insanity, sue everyone you can think of and then arrest anyone involved on any law you can think of. First they came for the drunks and I said nothing.....

I'm surprised they didn't go into the bathrooms of the bars and arrest people for indecent exposure!!

What's the difference? If a bar is a "public location" then so is the bathroom of the bar.

Cool I would like to...

point out a few things, if no one minds...

The cut off level for public intox is .08 in Ohio. Thats one drink. If I go to the bar and have one drink, then I am legally not allowed to drive home. All the police have to do is sit outside the bar all night and pull everybody over who comes out. Why go inside? As a warning to the bartenders seems like to me. I doubt this has anything to do with people drinking in bars.

If someone sits at the bar all night and gets served twenty drinks, the bartender knows he's smashed, but he still serves them. Then at closing, he boots them out to drive home on the pinball express, better known as our highways....

It really didn't have anything to do with the drunks in the bars, it had to do with the bar-tenders.

No one said it was a public institution. It's a public venue, a place where anyone can get in. That's the kind of place to which the public intoxication laws refer.

The calculator says one drink will produce a blood alcohol level of .02 for a 180 pound person. Of course, there are all kinds of drinks. They consider "a drink" to be one beer or a cocktail with one shot of liquor. If you get a tall glass with six shots of rum, a slice of pineapple, and an umbrella it's an entirely different matter.

A bar is not a place to get drunk at. You may have a couple of drinks until you hit the 0.08 blood alcohol limit, then its time to hang it up. I've seen too many horror stories about drunk drivers who have killed entire families to want even one on the road.
