Supreme Court justices sparred Thursday over police searches in a case that could signal a change in direction for the Court after the arrival of two new conservative members.

The Court has been generally cohesive and congenial under new Chief Justice John Roberts and in the three and a half months since Samuel Alito became the new junior justice. Earlier this week, for example, the justices ruled in four cases and were 9-0 in each.

They appeared fractured, however, as they debated for the second time whether police can rush into a home without knocking and seized evidence for use at a trial.

Is it me or does this whole idea of no knock breaking and entering warrants seem like a very STUPID move that could see many Police shot or possibly killed? Isn't that an instance of justifiable use of deadly force if someone breaks and enters into a dwelling?

So this is what could happen: I hear a knock (barely, because I'm chillin' in my basement) and all of a sudden I heard the door being smashed open or knocked down, I reach for my gun, attempt to shoot the invader running down my stairs, and either

A: I shoot the officer, and all of a sudden I'm a murderer when I think I'm protecting my own life

or

B: I get shot dead because the officer sees me holding a gun, and now I'm dead for no legitimate reason.

Thats sick.

I got a door just like yours. A bunker buster would sound like a knockety-knock. I am sure it is the same in your part of OH-High-YO as it is up here in NY the welfare State. If you go kickin' my door down, ya might get shot and then we are in trouble. It is just a reflex action, what the hell are you supposed to do? You have to protect yourself. You can't shoot back if you're dead. Stand outside in front of the lights with a bullhorn yell "Cops..Search warrant" with the red lights flashing and the bunker surrounded and save us all a little trouble.

Cool All joking aside....

I have had police officers come to me and say, "We need you to come to court tommorow and see about this warrant, OK?"

Now, it wasn't anything serious, but still, what has happened to our society? Are the police so afraid of us, and we so afraid of them, that we are nothing but enemies now?

I can remember when all the city police were my friends and we were all on a first name basis. It's sad to me that it's gotten to the point it has in todays society...

We've lost something that we probably won't be able to get back, folk's.

Thats too bad for all of us....

You're right. It is filled with reprinted articles, and probably not a problem (although I really dislike the excuse "everyone else is doing it"). Most people don't print the copyright warning though. I don't know enough about copyright infringement to be able to say whether there would be a problem with all the atricles posted on this site. Does anyone ever get the "expressed written consent of the original author"?

We reprint copyrighted materials under the "Fair Use" doctrine, which states that such material can be reprinted for nonprofit educational purposes. That said, printing the copyright notice seems to be tempting fate.

He have had a very few instances in which authors/publishers objected to such use. Rather than make a federal case of it, we simply deleted the articles in question.
