Default Man Arrested for Videotaping Police

A city man is charged with violating state wiretap laws by recording a detective on his home security camera, while the detective was investigating the man’s sons.

Michael Gannon, 49, of 26 Morgan St., was arrested Tuesday night, after he brought a video to the police station to try to file a complaint against Detective Andrew Karlis, according to Gannon’s wife, Janet Gannon, and police reports filed in Nashua District Court.

Police instead arrested Gannon, charging him with two felony counts of violating state eavesdropping and wiretap law by using an electronic device to record Karlis without the detective’s consent.

and apparently he should of called his lawyer and filed a civil suit to handle the officer's action's if there was any illegality concerned.

Cause it's kinda stupid to expect the cops to arrest the cop who's investigating your son....

Let's see if I understand this, and if I don't please make me look like a fool.

A father using a survance camera in the home of his son, which I am going to go out on a limb and say had given his father permission to do this, and he catches a detective "investigating" his sons. To my understanding, perhaps I am not aquantied enough with that state's laws, if the filming takes place entirely within privite property, their shouldn't be a single thing to nail the father, so long as permission from the owner of the home has no complaints.

Perhaps I am entirely lost. Oh well.

If this becomes a precedent it could solve a lot of problems for the police. Anyone videotaping police brutality could be arrested for violating wiretapping laws and have the video seized or thrown out of court as "fruit of the poisoned tree".

Does this mean that anyone videotaped without their permission can have the cameraman arrested or does it only apply to the police? Can people at traffic stops have the officer arrested for running his car camera to record the stop without asking for permission? Can PIs following an errant husband/wife be busted for taping his/her indiscretions?

This is one of the stupidest things I've ever seen. I wonder how it will play out?

Two little comments:

1: dedbr; My comments can out a bit bizare compaired to what I was trying to suggest (I was tired give me a break). I had ment for my post to suggest that perhaps the article didn't have the information right. Perhaps there was something else that the man was arrested for that the article perhaps missed.

In otherwords....my bad

2: On a second note, I totally agree with Buzzby's concern. If the artice is correct (which I still have my doubts until I see another article, just because this is so weird), and this were to set a precedent just imagine the type of damage to small business's with security camera's; or heck anyone with a security camera for that matter.

Scary stuff.

In a public place such as a street, traffic light, club or bar, there is no assumption of privacy and you can be videotaped and (correct me if I am mistaken) audiotaped. Much like the local 7-11, banks, etc.

At a private home, there is the assumption of what is done is done in private. I am unsure if that assumption extends to visitors to the home or just to the occupants of the home however.

-just my random thoughts on the subject.

lets not get hasty....

The best thing to assume is what we know as fact. All states are different in their laws, we know that to be true in herb laws, so we can assume that in privacy laws, too.

That's one of the reason's it's so hard to give advice on search and siezure. All states have different standards for what they will and won't allow, so there's really no standard answer.

I know here locally, whats OK in Ohio sure isn't OK in Indiana, and sure as hell isn't OK in Kentucky......

That's why I like it.....
