| No, a single cigar or a pack of papers CANNOT be considered paraphenilia in and of itself. If he was charged, he should have taken it to court, because both papers and cigars certainly have other uses other than smoking pot. If there was weed found in the area, or the person was obviously under the influence of marijuana, the charges might stick. Otherwise, you cannot be charged for simply having a cigar or papers. Cigars are smoked on their own, and when i do crave one, I rarely buy more than one. papers are used to handroll smokes, so unless the officer had a damn good reason to believe otherwise (like evidence of marijuana use, or marijuana itself) the charge would have been dropped in court. ALL he had on him was papers? Are you sure he's telling you the complete truth? I've never heard of such a thing happeneing, and I'm pretty well educated when it comes to drug laws, as not only have a been a smoker for quite some time, but also have a bachelors degree in criminal justice.

| He could've been lying but he seems like an honest person, and there was really no reason for him to lie about this, he's not the type that just makes it up. I guess he just found it easier to pay the small fine instead of taking time off to go to court and such, but I'm pretty sure it happened. Maybe they also had weed on them and I'm forgetting that part of the story because it was so long ago, but regardless, he did get a ticket for having papers. There are too many ambiguous phrases when it comes to paraphenalia in the Texas Law Statutes and papers could easily fall under like three of them. |

| yeah, theres probably more to the story. I too have gotten paraphenilia charges for having papers, but its hard to argue any other use when you already have 3 rolled joints right beside them!!! |
