| I was thinking about buying a small digital scale to make sure people don't rip me off, but my friend said that if you get caught with a scale then you can get charged with dealing. Is this a big deal? Should I not get one? |

| You can't get charged with distribution for just having a scale. Even if there is residue on the scale. Scale + Weed does not necessarily equal distribution in a court of law. To get charged with distribution, you need a lot more things. You need individual baggies, you need observed buys, and you usually need weight. Scales aren't illegal, obviously, you can buy them from public businesses. But they're all part of the "reasonable suspicion."

I'm not positive if the following applies nationwide or not, but in my state you can be charged with possession and/or possession with intent to distribute if you are caught with a scale that has mj residue. Original poster - If you do buy a scale, you need to be EXTREMELY careful about where it goes/what you have with it.

| Scales and bags are circumstantial evidence. They are not, of course, illegal in and of themselves, but combined with possession of marijuana they could be enough to convince a judge or jury that the weed wasn't just for personal use. Would they get a distribution or possession-for-sale conviction just because you had a scale with a bit of marijuana residue on it? Probably not. But if you have a scale, an ounce of weed, and a bunch of baggies, it would be pretty hard to convince a judge or jury that the weed was for personal consumption.

| They really can't do anything about just a scale. If you get caught with it just say it is for cooking or some science project and they can't do anything. If you have any weed on you then you may be in trouble (especially with baggies/weed/scale). but in my experience you have to be kind of stupid/reckless to get caught with weed anyways. Don't be paranoid about it and don't give cops any excuse to talk to you and you will be fine. |

| In Ohio, a persons house was raided and scale, baggies and herb were found, but all in different places. The scales were in a cardboard box on top of a shelf in the closet. The occupant had less than an ounce of weed, and in Ohio it is a minor misdeamenor for that, but he was also charged with a violation called "criminal tools" for the scale, which is a felony in Ohio. No residue on the scale, and when asked what it was for, the owner said it was for weighing gold and silver he bought on the open market. They had to drop the charges because no "criminal" activity had been directly obseved by the police. But yes, in Ohio you can be arrested and charged for scales, and it can be quite serious.
