Around Feb. of this year I was discussing airsoft guns with my friends. I have 2 CO2 airsoft pistols and 1 bb pistol gun. I was unaware that it was illegal to brandish and discharge these "firearms" as everyone into airsoft play it in parks by their houses and such so I thought it would be fine to go to a park and show my friends the guns. We went to a park that was fairly close to an Elementary school and this is where the felony charge brandishing and discharge of a firearm within 1000 ft. of school property comes from.

Now we were unaware that you can't have a firearm within 1000 ft. of school property. We believed that because we were quite far away from the actual school and not on school property, and in fact quite a ways from the fence surrounding the perimeter of the school with the signs on it saying no firearms tobacco drugs that we were far enough from it. Not to mention I was the one with the firearms and I literally got out of the car right next to somebody's house and I was legitly on park property as soon as I stepped out so its like wtf...


Anyways I believe we can probably fight off the felony charge and get it reduced(hopefully) and we have a lawyer who we are meeting on Tuesday. My question is in regards to probation which I have quite a good chance of receiving and smoking marijuana. I have never been put on probation so are there any initial drug tests/screens? Also when do you think it a good idea to stop toking just to be careful if the court date is July 2 according to the witnesses(my friends)? And one last question if I do get put on probation I have heard of people smoking while on it so how risky is this, and how do you help reduce the risk of being fuxored by a drug test?

A few years ago a couple of my friends got in trouble for shooting airsoft guns at their friends in my high school parking lot. They were arrested and put in handcuffs. They tried to make a big deal about it in our local news sayign teens went on a shooting rampage at my high school. The whole thing was overhyped and eventually they let it go because they were all good students and football players and had rich dads who were lawyers. I think they got a misdamenor and put on probation and only got detention.

I would assume that you wouldnt get drug tested if you get put on probation because it wasnt a drug or alcohol related accident. But i really dont know so dont take my word on it. And it seems like a pretty weak case for them so you should be able to fight it easily. Good luck.

Yea thankfully the security in my school aren't assholes and after they searched me they were like well we don't even know you so yea school won't do anything. My lawyer told me to go get recommendations from my SRO and the head of discipline and from what they told me they'll write me one easy.

The whole situation was really screwed up. The cop detained us at the location for 3 hours in the cold and constantly made degrading remarks. Not only that but I would say more than halfway through the thing he finally says "so boys want to know your rights? well you already know your rights probably from tv" at this I told him that we did not know our rights and would like to be read them so he told us we have the right to be silent and etc. Not more than 2 minutes later he began threatening to charge my two other friends if i didn't start telling him the truth and talking. Isn't it against the law for a cop to make threats based on the breaking of your rights?

In any case I hope I don't even have to deal with probation but if I do I hope I won't get tested. One of the kids in my school got charged with felony grand larceny and got probation and only got tested once because of suspicion(teacher searched phone and found texts that referenced marijuana).

But realistically should I even attempt to purge my body of THC starting maybe a month before July 2? I have quite a fast metabolism(6'1'' and only like 130 pounds) and I would drink and run a lot to pass.
