The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people. The federal government came to our home in Michigan and siezed our property because of medical marijuana and firearms. All though because of the 10th Amendment, if it isn't stated in the constituion, the federal government should not be able to come sieze property that the State says is legal. If people in each state choose to decriminalize marijuana, the constitution plainly reserves them the power to do so. For the first time since 1996, whn the Compassionate Use Act was passed the federal authorities have been charged with violating the 10th amendment for harassing mdical marijuana patients and state authorities. There is a judge that says Feds violated 10th amendment rights by subverting state marijuana laws at http://www.times-sta...com/ci_10461558 The Supreme Court ruled that the federal controlled substance act does not contain any exception for medical necessity. Some Lawyers argued that exception or no exception, the controlled substance act "exceeds Congress' commerce clause powers" and infringes the Fundamental liberties of the people under the fifth, ninth and tenth amendment. How come the ATF can just come in your home and seize all your firearms and medical perscription? Please comment and help me better understand things or just let us know what you have learned or experienced that would help us with our case. We are going through a rough time figuring out how to fight this so if you have any information that you think might help us please post it. Thank-you for reading, Scott and Danielle
Because the feds don't have much (if any) oversight, as to the way they operate. they've gotten way too big for their own britches. I'm sorry to hear of your run in with those scum bags, at this point your only hope is a great attorney. because the feds wont even listen to their own admin. law judge. and they ignore these so-called memo's from the white house with regards to leaving the medical patients alone. it would seem that they think they can just do whatever they want, and without having anyone to answer to, they've been getting away with it for many years. get a lawyer, you are gonna need one. ~Stoney~
