Default A DUI question...

So i recieved a dui for alcohol in febuary and went to court in june for it. This was is my first offense. So I recieved community service which i finished, finished dui school, finished being breathalyzed for 30 days straight, and am almost done with counsiling since the judge cut me a deal so i only had to go to about 9 meetings.

Now I was expecting to have a drug test when I was being breathalyzed, or when a probabation officer came to my house to inspect my room. And my room was clean btw.

The judge never said I was on probation. I havent smoked in a while and I'm positive I can pass a drug test no problem.

But I was wondering if you think I'm going to be drug tested. I'm not in drug court and have never been in trouble for anything but alchohol.

I could use some advice.

I'm not a lawyer, and you don't mention which state you're in-- but it almost sounds like you might be on deferred adjudication. That means that if you successfully complete your requirements and behave yourself for the prescribed amount of time, then you don't get a CONVICTION. That's where it differs from a true probation. I was on deferred for 6 months following a misdemeanor MJ possession charge about 15 years ago. Did the judge say anything to you about the charges being dropped upon successful completion, or there not being a conviction entered if you succeed?

However, deferreds can still show on your record until or unless you have them expunged-- depending on state.

In any case, if it were me-- I would play cool, stay clean until the end of the period, and ALWAYS count on a surprise test, especially at the end of the period when they might think you'll let your guard down and mess up. Then, after it's all behind you, celebrate with your favorite vice.
