Ok so I recently got into some legal trouble. It will be six to nine months before they file charges. In that time my lawyer stated that it would be a good idea to do some monthly drug tests, and my parents are pressuring me to do them as well. I told them I would because I am in some very serious legal trouble. I would like to continue smoking marijuana however, so I had a couple questions about drug testing.

1. If I fail a drug test that I have chosen to take on my own accord, could anyone else know, namely the police or the prosecuting attorney.

2. Is cheating a drug test illegal? What would they do if I were to get caught with a piss bag?

To answer your questions.....if you chose a site to test at and don't tell anyone of the place then you are good to go. But...if you go get tested and test clear a time or two and then test dirty, that could be different. When you request your clean test results you will get the dirty result as well. On MOST occassions a court will only "honor" a drug test that has been observed. They KNOW that people will TRY to cheat the test, therefore they try to stop efforts from people trying...observation is one way.
2. First of all....job related testing and court ordered testing are different. If it's job related, then you just don't get the job....but....If caught trying to cheat on a court related drug test, it is consider a felony. If you were to get caught then you will probably have to stay at the site (they can make you do that since it is court related) until you are able to void again and do an observed test....and they won't be leanient at all if they knew you already tried to cheat the system. I remember when I was on probation (I had a legent shy bladder which they took as my trying to avoid a test) I was told that if I had to I would sit there all day until I was able to test. Of course I was clean but it was before I had meds to help with my problem. I was treated like a hard core crimminal until I was able to show just cause that I had problems voiding on command during an observed test.

It is illegal in most, if not all States, to adulterate, substitute or in any other way try to cheat a legally administered drug test givben by anyone, (courts, employer, etc.). It isn't usually prosecuted except for those caught cheating on court ordered testing.

Most courts won't accept any test result where the results aren't sent directly from the laboratory conducting the testing to the designated court representative. In other words, you can't pick and choose which results you submit to the courts. They, not you, would receive ALL test results. You pay (cash) for the tests, but they get the results.
