| I am a fairly heavy smoker and have been for the past year and a half or so. I have a court date on Jan 4th for weed, and I just stopped smoking completely on Dec 3rd (32 days before court). I am 5'7", 130ish lbs with a moderate metabolism. I expect to be put on probation on that court date, but my situation is weird. I go to school outside of the US, and I will be leaving the country to go back to school right after leaving court. My question is, do you think they will still want drug testing? Would they have me do a drug test the day of court? If so, is 32 days enough time to get clean enough? Your thoughts... |

| By fairly heavy smoker I mean usually 4 or 5 times a day. Also, I do almost no exercise. |

| Being a heavy smoker of 4 to 5 times a day means your toxin levels are very high. Luckily you aren't too big of a person so it'll be out of you faster than someone such as myself who weights 315lbs. Drink plenty of fluids, exercise, and eat a low fat diet with plenty of fiber. If you want some piece of mind go buy a few home tests and when you are getting closer to your court date try testing with your first urine of the day. If you pass your in the clear. | USUALY if court sentences you to probation, you're not tested that day. What happens is they will assign you a Probation Officer who will then contact you to set up an appointment. At your first appointment you will be tested. No saying how long it will take from your court date to your first meeting with the PO (can be 1 day to weeks). My advise in your situation is to quit smoking now and do everything possible to pass that first test. Your PO could actually not let you leave the country of even the state if they choose, however this would be unlikely especially if you pass the first test. I doubt that you would be tested outside of the country, but if you come back home they may do a test. Again, laws vary from state to state, and different PO's handle things differently. It's best to be respectfull of your PO and pass all tests. |

| So you think the court might put my probation on hold until I return to the states for the summer? My summer is a 4 month period which is 2 months short of the minimum probation length. It would mean I stayed clean these first 30 days for nothing. Does anyone know enough about court and probation and stuff to come up with a guess of a possible outcome for this situation? If it helps, I'm being sentenced in Wisconsin. |
