| Hi! My husband was busted in Broward County with over 20 grams. Our attorney is trying to get him in the Drug Court program...he has to appear before the judge on Jan 19. The prosecutor is trying to say he is a dealer, which is not the case. We are both chronic users. What are the chances that he will get a drug test that day? We live in VA and the attorney tells us that he is going to try to get it moved to VA. I am currently concerned about him being tested at the court that day. Or, is OK to have a dirty test the first time? We are thinking that maybe it would be good to show up dirty....if he was clean that might give them fuel to fire the dealer issue. Really looking for any thoughts -- do they do drug tests the same day as a hearing? Also, need to get ideas for a cleansing program for the future. He is 5'7", 185 lbs and smokes chronically!!!! | If this is his first offense I'm sure they'll offer him probation. He'll probably have to do some community service and attend a drug counseling class or two. That seems to be the standard offer. 20 grams is hardly enough to classify him as a dealer. They're just trying to freak you out. I doubt he'll be drug tested until after the case has been settled and he is assigned a probation officer. |

| If it's a first time misdemeanor marijuana offense, chances are he will get a fine and court supervision.

| Thanks to you guys for your thoughts! This is a felony charge we are dealing with, wish it was misdemeanor. He was caught with 2 lbs., they way we deal with it, hardly enuff for anyone else! Peace, Flamingo |
