| I was talking to a buddy of mine a little while ago & he told me that once you take a drug test & either pass or fail, that information stays on your record & can affect future employment opportunities..This guy is real conspiracy theory nut & I frankly don't believe this but I wanted to ask you guys out here because I am sure someone would know for sure.. He also said that if a person is caught subbing or diluting that goes on file too. |

| It stays on your personel file, in your employers LOCKED filing cabinent . But, it can not be revealed to anybody without YOUR WRITTEN consent. This means a prospective job or a current employer. A positive can only be used against you for 2 years. If you spiked one, and got caught, they normally make you retest observed, but the spiked test is discarded. Only the immediate chain of command can be informed of the contents. If a fellow employee happened across these secret files, you can, and should, raise holy hell. That is a state, federal, and DOT law. State laws are more leanent compared to federal, ( in your favor), you can be reinstated to your job, (or win a law suit), if they did not tell you how much time you had to decide to get a spilt retested. Bottom line is the records can not be revealed without YOUR written consent. (period). I have seen my old test results dating back to 1989. You can view them upon request, and you can ask the testing site for a copy of the results. |
