| I was put on probation in January of 2005 for a charge unrelated to drugs or alcohol. Tomorrow I am supposed to go into this Drug couseling clinic of some sorts and take this drug evaluation. I was wondering if anyone else had this court ordered to them, and what exactly happens? I asked what all it entailed and how long it would take and they said I am supposed to sit and talk with this counselor for about 2 hours and afterwards they refer me to a treatment program if any is needed. They never mentioned anything about a drug test, but I am still paranoid because I believe they could possibly do it since it is court ordered. I was previously drug tested in early June when I went to see my probation officer, and I figured that was the end of it because I wasn't in any legal trouble with drugs and I had paid $20 for the lab fee which I am assuming really only covers one test. Any information regarding what a drug evaluation/assessment entails would be much appreciated. |

| somebody plz answer, any information will help. If anyone has gone through any sort of drug assessment then plz post with everything you can remember/know. |

| I'm not worried about the alcohol part, because I don't really drink. I just put drug and alcohol evaluation because thats what it is called, not because I wanted to know about alcohol. |

It's sort of hard to answer your question, what exactly were you charged with? I went to an evaluation for alcohol. I was in there because i had a dui with alcohol. I had to go to the evaluation so they could figure out just how much treatment i needed, i knew i was going for 10 or 15 weeks to a class once a week. I was givin a written test, on it, if i answered yes or no to certain questions it determined wheather or not i had a problem. I was asked on some questions if i used drugs, i think marijuana was one listed, i answered no. I mean why admit to that if i wasn't arrested for it and was only caught with alcohol! They didn't need to know anymore than what i was arrested for. They asked questions like if i took risks such as running yellow lights, and some other stuff, i answered no. One thing that i didn't like is that it seemed like before i was givin the test the guy tried to trick me into admitting stuff like that. He told me somethin like not that you do some of the stuff on there but answer it as if you would do it. He said something like that and if you ask me it was almost like reverse psychology to which i didn't fall for and answered no to questions like that. I've even seen cops do things like run yellow lights or make illegal U turns but i wasn't goin to admit to that if it got me 15 weeks instead of 10. I'm sure that if i answered yes to using pot they would try and get me treated for drug use as well and probably give me a urine test. I completed my test, he looked at it and gave me the minimal 10 week class. I had to go once a week for i think 2 1/2 or 3 hours. For people who are in the evaluation for using pot, they will be drug tested. If you do have to go into a class you need to suck up to them and try and make them believe you just made a mistake, and i don't mean by giving them the i'm only in here cause i got caught attitude or you will find yourself failing the class and be in there longer and dishing out more money. I was in there for drinking so i had to answer yes to ever drinking a beer or somethin like that or they would know for a fact i lied about something. My evaluation didn't take 2 hrs, i'm not even sure if you will get a written test or not, the guy just might want to talk to you and see what your problem is which is why they told you about a possible treatment program if any was needed. If you yourself use marijuana and they don't know that and you were never arrested for it, i certaintly wouldn't admit that to them, even a lawyer would probably say the samething. Mine told me not to tell them anything they didn't know. If they put you in there for pot, your class would be more focused on that and drug tests. If your in there for alcohol they don't drug test and focus more on drinking and the problems it causes. All i'm really doing is trying give you some idea of how a drug/alcohol evaluation is. You were arrested for something non drug or alcohol related. Only stick to what you were arrested for when you talk to the guy. All the program did for me, if i was arrested a year after completing the program for another dwi, it would count as my first offense and not my 2nd. If i was arrested within the same year of taking the program, i would fail the program and the charge would go down as my 2nd. You can only take that program once. I would probably lose my license for a year though if i was to get one now, it's been 3 years since i took the program. When your just going once a week for classes, it's like sitting in a classroom, getting work sheets, watching movies on whatever it is your in there for, and having class discussions with the teacher. Like i said if you weren't arrested for drugs or alcohol then i wouldn't even mention to the guy that you do any of that and just stick to questions he might ask that had to do with you being arrested. Everything i said was basically advice my lawyer gave me. Whatever you were arrested for i hope you learned your lesson. I shouldn't have drank and drove, i convinced that to my teacher that it was wrong what i did, which it was. All they really want to do is make sure you just learned a lesson and won't continue doing what you did or if they think you didn't learn then you will be getting as much treatment as they can give you. I wasn't 21 when i got in trouble so i wasn't supposed to drink anyway, in class they would ask what we did on the weekends after each weekend, told them i hungout at my friends, admitted to drinkin 3 beers, i wasn't driving but she still lectured me about how i shouldn't drink and that 0.2 is the limit for under agers and that i would have been over it. If i kept up on telling her that i would have been possibly going a extra 5 weeks. After that if she asked what i did on weekends, just made up something like went to the movies or went to a party, if she asked if anyone drank i would say yes, said i was offered a beer but didn't want to drink it. As someone being young, it's just something some of us do, but the drinking and driving was my biggest mistake. When the class was complete our teacher called us into a room individually, she just told me that after how i answered questions in class, i just made a mistake and didn't feel i had a problem and didn't need further treatment. When they ask you about your arrest, like i said before, hopefully you really did learn a lesson from what you did and won't continue to do it, if you suck up to them and convince them you just made a mistake atleast do yourself a favor and learn from it and try to keep yourself out of trouble. All i'm able to do is just tell you my experience from what i did wrong and tell you about that specific program, alcohol or drugs isn't related to whatever you were arrested for so it's hard to say what they will ask you in that area. It was also awhile ago when i was arrested and had to go for this, been 3 years, so i want you to read this as my opinion and not as 100% facts, things might have changed since then, depending on what you were arrested for might contribute to a drug test anyway but i can't be sure of that. You wanted someone who has been through that course to reply so i did. You now have some idea of what an evaluation is, it's basically about looking into a problem and figuring out how to treat it if you have one. I think your just getting evaluated so they can make sure you don't have any type of substance abuse problems that might have contributed to your arrest. If you tell them you use pot or tried it, then i'm willing to bet you will be going to classes for it if you tell them that and get drug tests. If your 21 years of age and admit to drinking a beer once in awhile but not drinking 5 or 6 a day i don't think they will give you classes for that because it's not enough to determine you have a problem. Maybe someone else can be of more help. |

| Thankyou so much for your help, all your information really put my mind at rest. I was arrested for a class D misdemeanor of shoplifting. I regret it so much that I dont really tell people why I'm on probation or anything like that. It was the first time I attempted to steal something, ever. It was in Nov. of 2004 and I'm still dealing with the consequences to this day. Anyway I really don't think they will drug test me because its at a family counseling place, and they don't know anything about my history with pot and I don't plan on telling them anything either. | You see the way our justice system works, you have done this less then a year ago. A backround check goes back 7 years. You Need to get it together, so that when you get a degree, it gets you a job. |
