| This may be kinda long .... My hubs interviewed for a position and they did a background check. He didn't get that position but they called him a couple months later for another position. He started immediately and is on a 30 day probationary period, supposed to be hired Feb.6th. Since the background check was done previously at the other interview, they didn't do another. He filled out all his paperwork except benefits info (since he's on a 30 day probationary period) and signed a paper about the company policy, which is if you get ticketed for a drug offense or caught w/drugs, you have to report it w/in 5 days. There's nothing in the company manual that talks about drug testing (only the policy I spoke of earlier) and he didn't sign a form saying he had to take a drug test. In the past, usually a drug test and background check go hand & hand. And they're done before the employer goes through the trouble of training and the rest of the paperwork. Anyone have any ideas as to the possibility of a drug test after his 30 days and before the official hire-on? Also, this is a law firm and from what we've heard from friends, drug testing at law firms is few & far between. Not sure if that's relevant .. just thought I'd add it. | If he were to get a ticket for Driving while drunk or Under the influence of a drug, and he doesn't tell them. The law firms reputation will be tainted if there is a case like his and he tries to defend it. The prosecuter would use that to their advantage in court.

| Thanks for the reply Do you think he'd still be tested after his 30 day probationary period, before the actual hire-on? I figured if a company did testing, it'd be in the company manual, which it's not. Only their 'report w/in 5 day policy' is in there. In my company's handbook, it's mentioned in two different areas about pre-employment testing, as well as testing b/c of 'suspicion.' I do understand why the firm requires them to report drug offenses, though. ~A & J~ |

| the prosecutor would never be able to use that information in court. The reporting of any incident is standard in the legal community, most firm/government attorneys are under a similar policy...most say "immediately." Oddly enough, most law firms do not do any type of drug tests....they'd loose too many employees. Attorneys are 2-3 times more likely than the general population to have a substance abuse problem. I'd tell him to stay clean until he finds out from another attorney (on the level) about random testing practices. |

| Yeah .. we have a few friends in the legal field and they weren't tested. Since he's only been there about 2 1/2 weeks, he's not cool enough w/anyone to ask them. Plus, since he's in the Accounting department, he doesn't have too much contact with attys. He's asked in a round about way, but noone has said anything about it. Since he uses herbs to help him sleep at night, the past week and upcoming weeks are gonna be hard for us But thanks for the info. ~A & J~ |

| I'd think, by now, they would've said something. Or had him sign a release form. Or it'd atleast be in the company handbook. From what I know, any company that does testing atleast has it in the company handbook. And, like I said, he's already filled out all the pre-employment paperwork including the background check and government forms. But we're gonna wait it out. He knows they intend on hiring him Feb. 6th so not much longer. I guess the upside is when he starts smokin' again, his buzz will come faster! LOL Thanks, again, for the replies. ~A & J~ |
