| A friend asked me to look into this situation for him. He was called at home and told he was to report to work in 12 hours (on his day off) "so the new health insurance company could draw blood and get a urine sample" He was told they were only doing the basic protien checks, HIV test, and other basic health screenings. A drug test was never mentioned by the technician or on any of the paperwork he signed. He was worried about them running a drug screen. they cannot do such a thing without his permission, can they? |

| I can tell you for sure that they couldn't release the information to his employer without his permission. Other than that I'm not sure.

| I have never heard of an employer making you submit to a drug to without your consent. Since I had my hair test in March, I have submitted blood and urn twice for lead levels. I am still working. ![]() |

| Nope. Employer based testing must be by informed consent. When your friend became employed, he/she signed paperwork consenting to a drug test as part of the orientation paperwork. That being said; each time an employee is tested, we have the CCF for them to sign and receive a copy of. (Custody and Control Form). The CCF specifically says that the specimen is specifically for a drug test. It is against DOT policy to misrepresent a drug test. For example, an employer cannot tell the employee that the test is "random" when it is really a "reasonable suspicion" test. So, if follows that an employer cannot lie to an employee and tell them that blood and urine are for health reasons when it is really for a drug test. A sort of rambling back door answer, eh? |
