| Hello all! My husband and i are REALLY STRESSED OUT. He has an upcoming drugtest for pre-employment. He NEEDS to pass -- we have a baby on the way. This job means a lot to us....anyways... He is a liscensed, medicinal Maryjane user. 215 lbs, chronic user. He hasn't smoked for 2 weeks and has been doin everything to deox. -natural cranberry juice -fiber -hella water -detox herbal teas -Qtabs-- does this stuff work? -He has a bottle of "The Stuff" he's waiting to bust the day of...does this ish work as well?? -mad excercise...lost 12 lbs since 2 wed. ago -daily saunas Can someone, anyone please offer some advice to his situation. Your thoughts on how he's going about this....if he's doing things right. Any info would help...from passing the test to rights of medicinal users. Please!! All we know is that he's hired he starts and a drug test is inevitable a few days after he has started. <--I thought that was weird! Should he just come clean about being a legal medicinal user? | I'm not sure, but I'd think that if you're a verified medicinal user then they can't fault you for it. Just like having a perscription for vicadin....it'll pop for opiates...but I don't think they can do anything if you have a Rx for it. Check your local laws and such. Maybe even speak with his doctor about it. It may depend on the type of work. I don't want to see a medicinal user operating a backhoe in my neighborhood, but anything where there isn't risk of bodily injury I don't have a problem with personally. |

| If they didn't care if you smoked pot, they wouldn't give a drug test. That has been discussed and answered a few times. You can use the search feature and find them if you want. Good luck. |

You may have a license to use marijuana, but that doesn't give you the right to be under the influence of marijuana on the employer's property or while in his employ. Look at it this way: Johnny has a prescription for whatever painkiller. Johnny takes 3 whatever painkillers a day, and it makes him very sleepy, but he goes to work. Is Johnny productive? no Is Johnny a liability? yes Could Johnny possible trip or stumble down the stairs and hurt himself or someone else? yes Could Johnny possibly (probably) get into a car accident enroute to or from work? yes Does Johnny have a legal right to take whatever painkiller? yes Does Johnny have a legal right to take whatever painkiller while at work? no That is the way they look at medical marijuana. You can take it, just not while working for a company that doesn't want you to be taking it while working for them. Do not tell the employer that you have a Med. MJ permit (license, whatever). Read up on substitution. That is your best bet. Can I ask: Why does he need the medical marijuana? If he can quit for two weeks and exercise like mad during that time, it cannot be because of pain. Why does he need it? |

| we've already had cases go to court on the medical marijuana question and drug testing in California....they've went against the medicinal user because of the Federal restrictions, and also the insurance is the reason for the drug screen in the first place and their not the friendliest towards medical user's for some reason..... I have been hired for a job, worked there for months, only to be told that certain medications I was taking would stop me from keeping my job if I didn't stop taking them and pass a drug screen to be sure I wasn't still using them, vicodin among them. In my opinion it's a bad idea to admit that you are a MM patient because you have to remember the stigma attached with our herb and also the majority of people still seem to think herb is illlegal, even though the law was passed allowing medical herb for some with a doctors recommendation in California and other states...... Some Where In Ded Land........

| well to answer your question "why does he need it"....he's been a server and food runner for six years, and yes its for pain....he has back pain. yes, hes exercising like mad..... he excercises everyday anyway--he just turned it up a few notches. the excersising actually makes his back feel better.....any other speculations... i mean questions? |
