Default testing car carriers

I'm thinking about switching jobs and I've always been so lucky to never get tested but the line of work I'm going into comes with random drug tests. I've always wanted to get my medical card because there are various different things that I smoke for but have never wanted to fork over the cash.

buuuut

If I get tested for drugs and come up positive for marijuana but have my card what can they do? Can they not hire me? can they fire me? isn't it a legal perscription by a doctor?

In cali, they can refuse employment if you fail a drug test even with your medical card. i dont know about other states, but in cali it is up to the employer.

Your medical card doesn't do squat for employment. You will be found to be positive if you fail a drug test, card or not.

You will be positive for Marijuana. However, with a medical card your employment may look at it differently, or, if you're very lucky, overlook it all together.

However, you're going to be a Truck Driver (car carrier Semi or wrecker?) your employer will have absolutely no tolerance for you doing Marijuana (under most circumstances) for legal reasons. If you get into an accident and hurt/kill/maim someone your employer would be fucked.

Having a medical marijuana card doesn't give you permission to drive while under the influence of drugs. Employers aren't required to make special accommodations for medical marijuana users. If you test positive and they don't hire people who test positive, they won't hire you.

No it's not. It's a recommendation from a doctor that cannabis might be an appropriate treatment for something that's wrong with you. Cannabis can't be prescribed. Only drugs listed on the US Pharmacopeia can be prescribed and cannabis is a federal Schedule I drug. It can't be prescribed for any reason.

No employer will test you, then overlook it. I had one employer, desperate for the labor, actually did hire a kid who tested positive for marijuana. The kid SWORE he stopped using. Well, the employer drove the kid to my facility about 3 weeks later. Total surprise to the kid. The employer simply said, "Kid, come with me", loaded him in the car and drove him to a drug test. The kid failed the test miserably. The initial test was barely over the cutoff limit (the kid was diluting, I could tell). The surprise test, 3 weeks later was one of the highest levels I have ever seen (Can anyone say "Busted"?) The kid was fired on the spot.

It isn't a matter of tolerance. The employer has no choice. If a driver tests positive and the employer does not remove the driver from a safety sensitive position, the employer could be fined a substantial amount. I have seen fines of $5700.00 for just allowing a driver to drive over the 11 hour rule. It is simply against the law for an employer to use a disqualified driver. Legal reasons aside, the financial reasons are staggering.
