I just read a post about a user that failed their test and their name being placed in a database. If you have failed a test do they put your name in a database for future reference??? Does this mean from this point on if you have a test it will be observed or any special provisions since you have failed a previous test??

That was me. I can tell you this much, I will never apply at that company again. And I don't for a moment think that data is safe. What about all the times you hear about banks, etc., losing computers or getting hacked into?

To make it worse, I was going thru a recruiter. Now my name is in their database too. Sux.

No, there isn't a database where other employers can access your drug testing records. It is forbidden for employers to share your drug testing information without your signed authorization.

IF you were fired for failing a drug test, and a potential employer asks your former employer why you were fired, then the former employer can be honest and say "I fired Jane Doe because she violated our substance abuse policy". this is perfectly legal, but as far as having a database of a list of names with pass or fail after, no, there is no such thing.

Good info. What about those cases when employers let you take a second one when you failed your first one (pre-employment)? Do they have to submit that drug test to somebody else or are they keeping? Because if they are the ones keeping it then any understanding person who knows a thing or two about grass would let have another shot at that.

I can't answer every scenario you think up. If an employer "lets" an applicant take another test because they failed the first one, then that employer is an idiot. Why waste time and money testing at all if you are just going to disregard the results.

Makes Sense... I was not referring to probation or any legal issues.. This was a pre employment test I was referring.. I just wanted to make sure...

Quite some time ago I was interested in the database situation. I failed a test a few years back and now have another one coming up WITH A DIFFERENT COMPANY... Any chance they can see that I failed one a few years back and make this one observed? This is pre employment for a different company than the one I failed. Thanks.

I know this was answered above, but it freaks me out to think I show up for my pre employment test and they say "I see you failed a test two years ago for company X, we are going to have to watch you piss"..... sucks...

There is a database for truckdrivers and maybe other safety sensitive type jobs. For truckdrivers its called DAC. They are a paid service that trucking companies can join and they keep track of drivers work history and drug tests. Most of the big companies are using this service. But a lot of smaller companies don't use DAC.
